送养孩子又反悔收养协议系无效？
　　小红出生于1997年8月，因交友不慎在2013年年底怀孕，且不知怀的孩子父亲是谁。许某、李某夫妇一直未育有孩子，打算帮助小红生下孩子并收养。日，小红与许某夫妇签订送养小孩“保证书”，保证书中，小红明确同意将生下的孩子送给许某夫妇抚养。同年10月，小红分娩一个男孩。小红在医院住院及生产小孩都是用李某的名字进行登记，住院的开支费用也由许某夫妇支付。孩子出生后，小红将儿子交给了许某夫妇抚养，取名许小宝（化名），并办理了孩子的户籍入户手续。此后，小宝一直由许某夫妇抚养，但许某夫妇一直未到民政部门办理收养登记。如今小红又反悔欲要回孩子，与孩子养父母协商未果对簿公堂。之前签下的“保证书”究竟有没有法律效力？（广西新闻网）　　法治滨海律师团：　　小红生育小孩时未年满18周岁，属于限制民事行为能力人，不能成为收养法规定的送养人。许某夫妇未依法办理收养登记，擅自收养小宝，且小红的法定监护人也不知情。因此，双方签订的送养小孩“保证书”的行为无效，小红送养孩子的行为无效，许某夫妇的收养关系依法不成立，小宝应归还给小红抚养。根据《收养法》规定，可以作为送养人的有孤儿的监护人；社会福利机构；有特殊困难无力抚养子女的生父母。小红对孩子负有法定抚养义务，&并依法享有监护权和抚养权。时报记者&刘纯　　（本版案例仅供参考）
